Tongal is committed to protecting the privacy of our users worldwide and we want to provide a safe and secure user experience. We will use commercially reasonable efforts to ensure that the personal information submitted to us remains private. Should you submit your personal information, it is immediately transferred from our web server to behind our firewall, where it remains isolated from a direct connection to the Internet. By using our website, and in doing so accepting the Terms and Conditions of Use under which you may use this website (see Terms & Conditions), you consent to the use of your personal information as described in this Privacy Policy.
Our Privacy Policy and security measures are periodically reviewed and enhanced as necessary. You should understand, however, that "perfect security" does not exist on the Internet. Information Collected About All Website Tongal Visitors and Why
We gather information about the visitors to our website, including without limitation, (a) internet domain and computer IP address, (b) which area(s) of the site are visited most frequently, (c) the type of device (e.g. iPhone, Android, etc.), browser (e.g. Google Chrome, Safari, Internet Explorer, etc.), and operating system (e.g. iOS, etc.) used to view the site and (d) if the visitor linked to our website from another website, the address of that other website.
We use this information for analyzing trends and statistics, fraud protection, improving our services, planning website enhancements, providing customer service and support, providing technical updates, sending administrative messages, communicating about projects and promotions, and measuring overall website effectiveness. From time to time we may reveal or analyze general, anonymous, aggregated statistical information about our website, services and visitors, such as the number of visits, the geographic location of visitors, demographic information provided by the visitors, and what website features they use. We may ask for geographic information to help us with privacy related compliance, to help us with projects that may have a geographic requirement, and to better understand demographics for internal purposes. We may provide links to other websites that we believe can offer you useful information. Tongal also has accounts on third-party social networking sites that let you connect with and follow Tongal on those sites. Tongal also allows you to sign up and login through your Facebook or Twitter account.
We are not responsible for the privacy policies of other websites, including those websites on which our logo or other information supplied by us appears, and Tongal cannot control how such third parties may collect, use or secure your data. This Privacy Policy only applies to information collected by tongal.com. We suggest that you access other websites' online policies regarding their own privacy and data collection practices.
Personal Data We Collect
Customers & Potential Customers. If you express an interest in obtaining additional information about Tongal, through our website or through one of our team members, we may request that you provide personal contact information such as name, title, company name, address, phone number, email address, and other information about your potential business needs.
Community Members. If you choose to register as a member of Tongal, you will be required to provide us with information about yourself, including your name and/or company name so we can identify your submissions, email address so we can contact you about matters such as your submissions, projects on which you are participating and prizing, and birth date to confirm your age. Once registered, you will be able to add additional optional information about yourself such as a photograph, location, gender, ethnicity, employment status, skills, among other data about yourself. A Tongal member's name, location, websites, information provided in the 'Settings' section, skills, and brands you have worked with on Tongal, will be publicly available to any visitors to the Tongal website. You have the ability to update and change this information at any time and we encourage you to keep it updated. Should you not wish this information to be viewable by visitors of the website, please do not enter this information into your profile. By participating in a project, you will also be supplying us with your words, ideas, concepts, scripts, pictures, videos, or other information that you choose to submit. We may aggregate these submissions with other submissions to analyze the data or to provide to a Sponsor of a project. On select projects, we may also make your submissions available for public voting on our website.
From time to time, we may use the contact information to alert members of new projects and communicate news, relevant information, events, and reminders. During a project, participants to the project will be shown and identified only by their handles, which are their public login names and their photograph, if they choose to upload a picture.
Visitors to the website may be allowed to view a project without identifying themselves, but project participants must be members logged in with their email and password. Winners' names and earnings may be released to governmental authorities as required by law.
If you are a winner and a U.S. person (including U.S. resident aliens), we will request your social security number (or taxpayer identification number) on IRS form W-9. If you are a winner and you are not a U.S. person, we will request a Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding on IRS form W-8BEN (Individuals) or W-8BEN-E (Entities). We use this information to verify your eligibility to participate in projects, and to contact you and properly notify the IRS, as necessary, should you be a winner.
The personal information you provide must be accurate and complete, and all registration details (where applicable) must contain your real name, email and other requested details. You are solely responsible for your personal information and we may take any action with respect to your personal information we deem necessary or appropriate if we believe it may cause Tongal, our community, or our customers to suffer any loss, liability or commercial damage.
Managing Information on Your Tongal Account
Tongal will provide you with a reasonable opportunity to review the information provided by you, as well as a reasonable opportunity to correct any erroneous information. To view or correct your information, log in to the Tongal website, and click on "Settings" from your "Dashboard" page.
You may manage your receipt of marketing communication by clicking on the "unsubscribe" link located on the bottom of Tongal's
marketing emails or by opening the "Email Preferences" section in the Settings section of your Dashboard.
Forums
Tongal makes forum-style discussion topics available to our members and customers. These forums will identify Tongal members by their user handles and profile picture, if provided. Those simply viewing the forums may do so without identifying themselves, but those who wish to participate must be logged in members or customers. Please remember that any information you disclose in these areas becomes public information. Accordingly, you should always exercise caution when deciding to disclose any personal information in the forum.
Direct Messaging
When you use the Direct Messaging feature to communicate with other Tongal members, those members can see the content you send, including any links or attachments you send. Tongal sends out email notifications to the email account associated with your Tongal profile whenever you receive a new message. If you believe a message you have received is spam, you can choose to “Report Chat” to complete a form and have an administrator review the chat. There is also a “Leave Chat” button which will allow you to leave a chat and no longer receive updates.
Feedback
Tongal may ask you for feedback and comments about the website or the projects and we encourage your participation. Any feedback that is submitted becomes the property of Tongal and may be shared with third parties that we use to compile, analyze, and interpret such data. We may use this feedback, such as success stories, for marketing purposes, to enhance our capabilities, to create new features, or to contact you for further feedback.
Data Access and Portability
In some jurisdictions, applicable law may entitle you to request copies of your personal information held by us. You may also be entitled to request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format and/or request us to transmit this information to another service provider (where technically feasible).

Privacy of Children on Our Website
Our website is not intended for use by children under the age of 13, and we do not knowingly collect personal information from children under the age of 13. Anyone under the age of 13 is not allowed to be a member of Tongal. If you are in the EU and are 16 years of age and older, you may register for a Tongal account and use the website without parental consent.
Applicable Law
Tongal is based in the United States. By accessing our services you consent to the transfer of information to the U.S. to the extent applicable, and the collection, storage, and processing of information under U.S. law. Your information, including personal data that we collect from you, may be transferred to, stored at, and processed by us or our third party providers outside the country in which you reside, including the United States, where data protection and privacy regulations may differ from those in the jurisdiction in which you reside. We will take all commercially reasonable steps to ensure that your data is treated securely and in accordance with this Policy.
Your California Privacy Rights
California Consumer Protection Act and California Civil Code Section 1798.83 permits registered users who are California residents to request certain information regarding disclosure of personal information to third parties for their direct marketing purposes. California residents may have rights that are included in this privacy policy, such as disclosures about personal information, right to know, right to delete, and right to opt-out of sale. California residents may exercise these rights, subject to a verifiable request. Tongal only uses your personal information for the purpose of providing services to our customers and community. Tongal does not currently and does not anticipate selling personal information. For confirmation of or a request to delete your personal information, you may contact us using the information below. We will request certain information to verify your identity, which may include documentation, in person verification, or other methods and will provide information about the verification process within the time frame stated by law. If we are unable to verify your identity, we may deny your request.
